Pursuant to Article 13 of EU Regulation No. 2016/679 (hereinafter “GDPR 2016/679”) and Legislative Decree No. 196 of 30 June 2003, as amended, containing provisions for the protection of individuals and other subjects with respect to the processing of personal data, we wish to inform you that the personal data you provide will be processed in compliance with the aforementioned legislation.

1. Data controller

The Data Controller is RTA ITALIA S.R.L. in the person of its legal representative Andrea Cappelli, domiciled for the purpose in Cesena 47521 (FC) at Via Luzzena n. 4120.

2. Purpose of the processing

The personal data you provide is required to comply with legal requirements, including the appropriate communications to RTA ITALIA S.R.L., registration and notification to the Police Headquarters of the personal details of guests staying at the property, as determined by the identification documents they present, in compliance with current police regulations (Article 109 of the Consolidated Law on Police Laws), and mandatory communications of anonymous statistics to the relevant companies.

3. Processing and storage methods

The processing will be carried out automatically and/or manually, in compliance with the provisions of Article 32 of GDPR 2016/679 regarding security measures, by specifically appointed persons and in compliance with the provisions of Article 29 of GDPR 2016/679.

We inform you that, in compliance with the principles of lawfulness, purpose limitation, and data minimization, pursuant to Article 5 of GDPR 2016/679, subject to your free and explicit consent to this policy, your personal data will be retained for the period of time necessary to achieve the purposes for which they were collected and processed.

4. Scope of communication and dissemination

We also inform you that the data collected will never be disclosed or shared without your explicit consent, except for necessary communications that may involve the transfer of data to public bodies, consultants, or other parties for compliance with legal obligations.

5. Transfer of personal data

Your data will not be transferred to European Union member states or to third countries outside the European Union.

6. Special categories of personal data

Pursuant to Articles 9 and 10 of EU Regulation No. 2016/679, you may provide RTA ITALIA S.R.L. with data that can be classified as “special categories of personal data,” meaning data revealing “racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as genetic data, biometric data intended to uniquely identify a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation.” These categories of data may be processed by RTA ITALIA S.R.L. only with your free and explicit consent, expressed in writing at the bottom of this notice.

7. Existence of automated decision-making, including profiling

RTA ITALIA S.R.L. does not adopt any automated decision-making processes, including profiling, pursuant to Article 22, paragraphs 1 and 4, of EU Regulation no. 679/2016.

RIGHTS OF THE INTERESTED PARTY

8. At any time, you may exercise, pursuant to Articles 15 to 22 of EU Regulation no. 2016/679, the right to:

1. Request confirmation as to whether or not personal data concerning you exists;
2. Obtain information regarding the purposes of the processing, the categories of personal data, the recipients or categories of recipients to whom the personal data have been or will be disclosed, and, where possible, the retention period;
3. Obtain rectification and erasure of data;
4. Obtain restriction of processing;
5. Obtain data portability, i.e., receive data from a data controller in a structured, commonly used, and machine-readable format and transmit it to another data controller without hindrance;
6. Object to processing at any time, including for direct marketing purposes;
7. Object to automated individual decision-making, including profiling.
8. Ask the data controller for access to personal data and for rectification or erasure of the same, or restriction of processing concerning you, or to object to processing, in addition to the right to data portability;
9. Withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal;
10. Lodge a complaint with a supervisory authority.
